The Upgrade Party Launches AMEN28

A proposed 28th Amendment to create an independent, elected Chief Justice of the USA — overseeing the Department of Justice, Inspector Generals, and federal ethics enforcement.

Campaign Calls for a Nationally Elected Watchdog Office, Independent of the President

The proposal responds to a structural gap that has existed since the nation's founding: the U.S. Attorney General, the country's chief legal officer, is appointed by the President — the same executive branch the Attorney General may at times need to investigate or hold accountable. By contrast, 43 U.S. states currently elect their own Attorneys General directly, insulating that office from the same conflict of interest at the state level.

"An Attorney General who answers to the President cannot fully answer to the law," said Roy Hardman,, of the Upgrade Party. PLEASE WATCH THE MOTIVATIONAL VIDEOS ON THE AMEN28.US SITE.

What AMEN28 Proposes

Under the amendment, the newly created Chief Justice of the USA (CJUSA) would be elected by the American people on a four-year term, offset two years from the presidential election cycle to preserve independence from White House politics. The CJUSA would receive a salary equal to the President's and Secret Service protection, and would be subject to impeachment through a process comparable to the one used for the presidency.

The office of the CJUSA would hold jurisdiction over:

The proposal also calls for U.S. Marshals to hold law-enforcement authority independent of, and greater than, that of the Secret Service, and for the CJUSA to oversee independent auditing of federal agencies, including the military and the Federal Reserve.

Under the amendment's transition provisions, the nation's first Chief Justice of the USA would be selected by a simple-majority vote of the states' own elected Attorneys General, with future vacancies filled the same way (until the next election).

Why Now

The U.S. Constitution has been amended 27 times; the most recent amendment, concerning congressional pay, was ratified in 1992 — more than three decades ago. The Upgrade Party argues that a Constitutional Convention under Article V, which allows states to propose and ratify amendments independent of Congress, offers a realistic path forward: with the agreement of 38 state legislatures, a new amendment could theoretically be ratified in a single day. The organization has proposed that the day AMEN28 is ratified be recognized nationally as "Upgrade Justice Day."
