The United States Constitution has had 27 amendments. The last amendment was ratified in 1992. Some say that the USA has an Amendment Deficit Disorder, since many wonder if the USA would be better off with a few upgrades.
A Federal Constitutional Convention lets the states get together and create new amendments.
We propose that Amendment 28 (Amen28) be called the "Upgrade Justice Amendment".
Before we present Amen 28, let's ask 'What is an Attorney General?. An attorney general is the chief legal officer and chief law enforcement officer of a government.
In the US, 43 States have an ELECTED Attorney General.
Some States have APPOINTED Attorney Generals. At the Federal Level, the Attorney General is APPOINTED by the President.
To summarize, Amen 28 would create a new, elected position of Chief Justice and move every aspect of Justice, Ethics, and Auditing to be under the jurisdiction and management of the Chief Justice.
The "Upgrade Justice Amendment" could have these features:
- The position of Chief Justice shall be elected with a four-year term which is two years separated from the presidential election.
- The Federal Attorney General shall be appointed by the Chief Justice with Senate Approval.
- The Department of Justice will be under the jurisdiction and management of the Chief Justice.
- The Office of Inspector Generals shall be under the jurisdiction and management of the Chief Justice.
- The Congressional Ethics Office shall be under the jurisdiction and management of the Chief Justice.
- The Military Inspector Generals and Judge Advocate Generals (JAG) shall be under the jurisdiction and management of the Chief Justice.
- The U.S. Marshalls shall be under the jurisdiction and management of the Chief Justice.
- U.S. Marshalls are directed as having a rank or authority greater than that of the Secret Service
- The Chief Justice shall create and oversee the Plebescite Voting System (PVS = voice of the people) with either mail-in or secured Internet-based voting. The use of the PVS to be determined in a different amendment or by Congress.
- The CJUSA shall oversee the auditing of the military, the Federal Reserve, and other government agencies.
- The CJUSA can pause or cancel a Presidential Emergency Action. See PEAD. Also see NEA.
About the position of Chief Justice:
- The position of Chief Justice shall be elected with a four-year term which is two years separated (out of sync) from the presidential election.
- The Chief Justice shall receive a salary equal to that of the President of the United States and shall receive Secret Service protection.
- The same process used to impeach and convict the President of the United States can be used for the Chief Justice
- The ELECTED Attorney Generals of the states shall appoint the first Chief Justice with a simple majority vote and similarly appoint a Chief Justice in the event of the death, conviction, or other cause of absence of the position, The Chief Justice shall have a recommended replacement for the consideration of the States Attorney Generals.
Surely Amen 28 shall have several details added before ratification, including clarification of the Chief Justice relationship to the Supreme Court Justices.
